Terms of use and sale
1. Who we are
pivotwright.com, app.pivotwright.com and the Pivotwright products are provided by Matej Krajačić, Croatia, trading under the name Pivotwright ("we", "us"). Contact: support@pivotwright.com.
These terms apply when you buy or use our products: The Pivotwright Trading Manual (a PDF book), Pivotwright Journal (a web app) and the bundle of both. By buying or using them you agree to these terms. How we handle personal data is explained in our Privacy policy.
2. Buying through Gumroad
Our products are sold through Gumroad, which is the seller of record ("merchant of record"). Gumroad takes the payment, charges VAT or sales tax where it applies, issues the receipt and delivers the download or licence key. Gumroad's own terms apply to the payment. Prices are shown on our site and on Gumroad; the price at checkout is the one that counts.
Each product is a one-time purchase. There is no subscription and nothing renews.
3. Right of withdrawal and refunds
If you are a consumer in the EU, you normally have 14 days to withdraw from a purchase. For digital content such as a PDF download or a licence key, this right ends once delivery starts, if you agreed at checkout that delivery starts immediately and acknowledged that you lose the right of withdrawal. Refunds are processed through Gumroad.
Your legal rights if a product is faulty or not as described always remain (see section 9). If something does not work, write to us first and we will try to fix it.
If a purchase is refunded or charged back, the licence for that purchase ends: a journal licence key stops unlocking the journal, and you may no longer use the book.
4. The book: what you may do with it
When you buy The Pivotwright Trading Manual, you get a personal, non-exclusive, non-transferable licence to read it and print it for your own use, on any of your own devices.
You may not share, resell, upload, publish or distribute the book or parts of it, give it away, or put it into a shared library or file-sharing service, and you may not use it to train machine-learning models. Short quotations with a clear reference to the book are fine. All rights not expressly granted are reserved. The book is protected by copyright.
The free sample chapter may be shared freely as long as it is not changed and is not sold.
5. Pivotwright Journal
5.1 The licence
A journal licence key, bought on its own or in the bundle, unlocks the full journal for one account (one email address), on as many of your own devices as you like. It is for you personally: do not share it, sell it or use it on more than one account. "Lifetime" means the key does not expire and you never pay again for as long as we run the journal service.
Without a licence, the journal works as a demo with example trades.
5.2 Your data
Everything you enter in the journal belongs to you. You let us store, copy and transmit it only as far as needed to run the service for you, for example to sync it between your devices. You can export it at any time (CSV or full backup) and delete it with "Delete everything". Please keep your own backups.
5.3 Fair use
Do not use the journal to break the law, to store content you have no right to store, or to attack, overload or get around the security of the service. We may suspend an account that does this, or that uses a licence key shared or bought fraudulently, after telling you why where we can.
5.4 Availability and changes
We work to keep the journal running and improving, but we cannot promise it will always be available without interruption or errors. We may change features over time, as long as the journal keeps doing what it was sold to do: keeping a trading journal with a calendar, trades and statistics.
If we ever decide to stop the journal service, we will tell licence holders by email at least 90 days in advance, and you will be able to export all your data before it stops.
6. Not financial advice
All our products, including the book, the journal, this website and our social media content, are for education and record keeping only. They are not financial, investment, tax or trading advice, and nothing in them is a recommendation to buy or sell any security, currency, crypto-asset or other instrument. We are not a licensed financial adviser or investment firm.
Trading carries a substantial risk of loss and most retail traders lose money. Never trade with money you cannot afford to lose. Past results, real or hypothetical, do not reliably predict future results. Strategy tests in the book run on synthetic data and are examples of method only. Statistics in the journal show your own records and say nothing about future results. You alone decide what you trade and are responsible for the outcome.
7. Intellectual property
The book, the journal, this website, their text, charts, designs and the Pivotwright name and logo belong to us or our licensors. Fonts used are licensed under the SIL Open Font License.
8. Liability
We are not liable for trading or investment losses, or for lost profits, that result from decisions you make, whether or not you used our products to make them.
Apart from that, and as far as the law allows, our total liability to you for any claim about a product is limited to the amount you paid for it.
Nothing in these terms limits or excludes liability that cannot be limited by law, including liability for intent or gross negligence, for death or personal injury, or your statutory rights as a consumer.
9. Your rights as a consumer
If you are a consumer, you have the legal rights that EU and Croatian law give you for digital content and services, including the right to have faulty or non-conforming content brought into conformity, or else to a price reduction or refund. These terms do not take away any of those rights.
10. Law and disputes
These terms are governed by the law of the Republic of Croatia. If you are a consumer living in another country, you also keep the protection of the mandatory consumer law of that country, and you can bring a claim in the courts where you live.
If you have a complaint, please email us first at support@pivotwright.com. We answer complaints within 15 days.
11. Changes to these terms
We may update these terms, for example when we add a product or the law changes. The version that applied when you bought a product continues to apply to that purchase, unless a change is only to your benefit or is required by law. We will publish every new version here with its date.
